1. General Provisions
These Terms of Use (hereinafter — the "Terms") govern the relationship between FOP "BusEx" (hereinafter — the "Operator") and any individual or legal entity (hereinafter — the "User") who uses the BusEx.pro platform (hereinafter — the "Platform") to search, book, and purchase bus tickets.
By using the Platform, the User confirms that they have read these Terms, fully understand and agree to comply with them. If the User disagrees with any provision, they must cease using the Platform.
2. Definitions
- Platform — the BusEx.pro website and associated mobile applications.
- Operator — FOP "BusEx", which ensures the functioning of the Platform as an intermediary between Users and Carriers.
- Carrier — a transport company that directly operates the bus service.
- User — an individual or legal entity using the Platform.
- Booking — reserving a seat on a route through the Platform.
- Ticket — an electronic document confirming the passenger's right to transportation.
3. Service Description
The Platform is a bus route aggregator. The Operator provides Users with the ability to:
- Search for bus routes between different cities.
- Compare prices, departure times, and transportation conditions of various Carriers.
- Book and purchase tickets online.
- Receive electronic tickets and booking confirmations.
- Manage their bookings through a personal account.
The Operator is not a carrier and bears no responsibility for the actual transportation. Transportation is carried out by the Carrier based on its own rules and licenses.
4. Registration and Account
To fully use the Platform, the User may create an account by providing a valid email address. Authorization is carried out through a one-time code sent to the email.
The User undertakes to:
- Provide accurate and current information during registration.
- Ensure the confidentiality of their account.
- Immediately notify the Operator of any unauthorized access to the account.
- Not share account access with third parties.
5. Booking and Ticket Purchase Procedure
Booking is performed by filling out the search form (departure city, arrival city, date, number of passengers), selecting a route from the list of available options, and confirming the order. After successful payment, the User receives an electronic ticket to the specified email address.
Ticket prices are set by Carriers and may change without prior notice until the booking is confirmed. The price stated in the confirmed ticket is final.
6. User Obligations
The User undertakes to:
- Enter correct passenger data (first name, last name, date of birth) in accordance with documents.
- Carry valid identification documents during travel.
- Arrive at the departure point on time (recommended 15-30 minutes before departure).
- Comply with the transport rules of the specific Carrier.
- Not use the Platform for illegal purposes or fraud.
- Not disrupt Platform operations through technical means (scraping, DDoS attacks, etc.).
7. Carrier Liability
The Carrier is responsible for:
- Safe and timely execution of the route.
- Technical condition of the vehicle.
- Having the necessary licenses and transportation permits.
- Compliance with passenger and luggage transport rules.
- Providing information about schedule changes or route cancellations.
In case of cancellation or delay due to the Carrier's fault, compensation matters are resolved in accordance with the Carrier's rules and applicable legislation.
8. Limitation of Operator's Liability
The Operator shall not be liable for:
- Delays, cancellations, or route changes made by the Carrier.
- Quality of transportation services provided by the Carrier.
- Actions or inactions of the Carrier's personnel.
- Losses caused by force majeure (natural disasters, military actions, epidemics).
- Temporary unavailability of the Platform due to maintenance or outages.
The Operator's maximum liability is limited to the cost of the purchased ticket.
9. Intellectual Property
All Platform materials (design, text, logos, software code, databases) are the intellectual property of the Operator or its licensors. Copying, distribution, modification, or other use of Platform materials without the written permission of the Operator is prohibited.
10. Refunds and Changes
Conditions for ticket refunds and booking changes are determined by the fare rules of the specific Carrier. Detailed information about refunds is available on the "Purchase & Refund" page and in the Help Center section.
11. Dispute Resolution
In case of disputes, the parties undertake to resolve them through negotiations. If the parties fail to reach agreement, the dispute shall be resolved in accordance with applicable Ukrainian legislation. EU Users also have the right to use the European Commission's Online Dispute Resolution platform.
12. Governing Law
These Terms are governed by and construed in accordance with the laws of Ukraine. Where the User is an EU resident, mandatory consumer protection rules of the respective country also apply.
13. Changes to the Terms
The Operator reserves the right to change these Terms at any time. The current version is always available on the Platform. By continuing to use the Platform after changes are made, the User accepts the updated Terms.
