1. Subject of the Agreement
This document constitutes an official proposal (public offer) by FOP "BusEx" (hereinafter — the "Operator"), addressed to any individual or legal entity (hereinafter — the "Customer"), to enter into an agreement for the provision of information services related to searching, booking, and selling bus tickets through the BusEx.pro platform (hereinafter — the "Platform").
The Operator acts as an intermediary between the Customer and transport companies (hereinafter — the "Carriers"), providing the technical capability to search for routes, compare prices, and book tickets online.
2. Definitions
- Offer — this document, published on the Platform at busex.pro/offer.
- Acceptance — full and unconditional acceptance of the Offer by making a booking or paying for a ticket.
- Services — information services for searching, booking, and processing bus tickets.
- Service fee — the Operator's remuneration for services provided, which may be included in the ticket price or listed separately.
3. Offer Acceptance Procedure
The Offer is considered accepted by the Customer from the moment any of the following actions is performed:
- Making a booking through the Platform.
- Making a ticket payment through any available method.
- Registering an account on the Platform.
Acceptance of the offer means the Customer has reviewed and agrees to all terms of this Agreement, the Terms of Use, the Privacy Policy, and the rules of the respective Carrier.
4. Description of Operator's Services
The Operator provides the Customer with the following services:
- Access to the real-time bus route search system.
- Display of current route information, prices, and seat availability (based on data received from Carriers).
- Technical capability to book and pay for tickets online.
- Generation and delivery of electronic tickets.
- Information support through the Operator's communication channels.
- Personal account for managing bookings and trip history.
5. Ordering and Payment Procedure
The Customer selects a route, fills in passenger data, and confirms the booking. Payment is made through one of the available methods: bank card (Visa, Mastercard), online payment system, or other methods available on the Platform.
After successful payment, the Customer receives an electronic ticket to the specified email address. The ticket serves as confirmation of the transportation contract between the Customer and the Carrier.
The ticket price includes the Carrier's fare and may include the Operator's service fee. The final price is displayed before payment confirmation.
6. Rights and Obligations of the Parties
The Operator undertakes to:
- Ensure uninterrupted Platform operation (except for scheduled maintenance).
- Provide current route information based on Carrier data.
- Ensure secure payment processing through certified providers.
- Provide Customer support through available communication channels.
- Maintain the confidentiality of the Customer's personal data.
The Customer undertakes to:
- Provide accurate data when making a booking.
- Pay for selected services in a timely manner.
- Independently verify the correctness of ticket data before travel.
- Familiarize themselves with the transport rules of the respective Carrier.
- Not use the Platform for fraudulent or illegal activities.
7. Pricing
Ticket prices are set by Carriers and displayed on the Platform in the currency designated for the respective route (hryvnia, euro, or other). The Operator does not influence Carriers' pricing policies.
The Operator's service fee, if applicable, is displayed as a separate line item at checkout. The total cost is always visible to the Customer before payment confirmation.
8. Provision of Transportation Services
Transportation services are provided directly by the Carrier under a separate transportation contract. The Operator is not a party to the transportation contract and bears no liability for its execution.
The Customer must arrive at the departure point on time, carry a valid identity document, and have the electronic ticket (in printed or digital format).
9. Liability of the Parties
The Operator is liable exclusively for the proper provision of information services. The Operator's maximum liability does not exceed the service fee amount for the respective booking.
The Operator is not liable for: actions or inactions of Carriers, route delays and cancellations, quality of transportation services, losses caused by the Customer providing inaccurate data.
10. Force Majeure
The parties are released from liability for partial or complete non-performance of obligations if such non-performance results from force majeure circumstances: natural disasters, military actions, government decisions, epidemics, strikes, technical failures, and other circumstances beyond the parties' control.
The party affected by force majeure must notify the other party within 3 (three) business days of such circumstances arising.
11. Personal Data Protection
The Customer's personal data is processed in accordance with the Privacy Policy published on the Platform. The Operator guarantees compliance with the Law of Ukraine "On Personal Data Protection" and Regulation (EU) 2016/679 (GDPR).
12. Dispute Resolution
All disputes shall be resolved through negotiation. If agreement cannot be reached, the dispute shall be submitted to a court in accordance with applicable Ukrainian legislation. For EU consumers, mandatory consumer protection rules of their country of residence apply.
Pre-trial settlement is mandatory. Claims must be sent to support@busex.pro and will be reviewed within 15 business days.
13. Amendments to the Agreement
The Operator reserves the right to amend this Agreement. The new version takes effect upon publication on the Platform. Continued use of the Platform after publication of changes constitutes the Customer's acceptance of the updated version.
